Case against realtors’ board stalls

The first day of the federal Competition Bureau’s lawsuit against the Toronto Real Estate Board over its data has stalled. The court case which began Monday was halted as TREB objected to Justice Paul Crampton being involved as he was involved in a similar case a decade ago. The Globe and Mail reports that the real estate board’s lawyer William Sasso said he was planning to ask the Chief Justice to remove himself from the case but needed more time to prepare his argument.

In 2002 the now-defunct Realtysellers sued TREB alleging anti-competitive practices and Paul Crampton was a private practice lawyer at one of the law firms involved. Although there has been no specific evidence to suggest that he was personally involved in that case TREB’s concerns will mean a delay in proceedings.
